OPG and Lasting Power of Attorney: Understanding the Office of the Public Guardian

The Office of the Public Guardian (OPG) is the government body that oversees LPAs in England and Wales. Understanding their role helps you navigate the LPA process.

What Does the OPG Do?

1. Registers LPAs All LPAs must be registered with the OPG before use. They check the documents are valid and correctly completed.

2. Maintains the register The OPG keeps a public register of all registered LPAs. Organisations can verify LPAs are genuine.

3. Supervises attorneys and deputies The OPG monitors how attorneys use their powers, especially court-appointed deputies.

4. Investigates concerns If someone reports that an attorney is abusing their position, the OPG can investigate.

5. Provides guidance The OPG publishes guidance for donors, attorneys, and families.

The Registration Process

When you submit an LPA:

Week 1-2: OPG receives and processes application Week 3-6: OPG checks document for errors Week 6-10: If valid, OPG registers and returns stamped LPA

Registration Fees

£82 per LPA (January 2026)

Exemptions/reductions:

  • Benefits-based exemptions for low income

The OPG's Supervisory Role

For attorneys:

  • OPG can request information about how you are managing affairs
  • You must respond to OPG enquiries
  • Serious concerns can lead to court action
For deputies (court-appointed):
  • Closer supervision than LPA attorneys
  • Annual reports may be required
  • OPG can visit or audit
