Types of Challenges

Objecting to Registration

Who Can Object?

  • The donor (person making the LPA)
  • Attorneys named in the LPA
  • People notified in the LPA
  • In some cases, other interested parties

Grounds for Objection

Factual grounds:

  • The donor is bankrupt (for Property & Financial LPA)
  • An attorney is bankrupt
  • An attorney is under 18
  • An attorney has disclaimed
Prescribed grounds:
  • The donor lacked capacity when making the LPA
  • The LPA was made under fraud, undue pressure, or duress
  • The attorney behaved in a way that would have allowed the Court to revoke
  • An attorney proposes to behave in such a way

How to Object

  • Complete form LPA007 (objection form)
  • Submit to OPG during registration waiting period
  • Pay the objection fee (currently £0 for donors, varies for others)
  • OPG investigates
  • Challenging a Registered LPA

    Grounds for Challenge

    • The donor lacked capacity when signing
    • The LPA was obtained by fraud or undue influence
    • The certificate provider wasn't suitable
    • Procedural errors that invalidate the LPA

    How to Challenge

  • Apply to the Court of Protection
  • Complete form COP1 (application form)
  • Pay the court fee (£371)
  • Attend any hearings
  • Court decides on validity
